As owner of the goods you are claimant under the policy and, as per the policy conditions, you have to appoint the claims and survey agent that is mentioned on the Certificate. If the claim will be payable under the policy, insurers will also indemnify you for our costs. Usually, we try to recover the survey costs from the insurer directly. However, just in case they will not pay for our services, for example when the claim is not recoverable under the policy, we need you to pay for our services. You then will receive our survey report which you can use to eventually claim the loss from sellers/shippers, or any other party that might be responsible for the loss.
If the loss will require a survey, we will appoint a surveyor. After he completed the survey report, we will present the claim to insurers for consideration of payment of the claim. If no survey is required we will present the claim to insurers directly. If we are authorised to settle the claim, we will ask insurers for the loss amount and once received we will remit same to you. Before payment of the claim we will ask you to sign a subrogation form with which you will subrogate your rights to insurers who are then entitled to recover the claim for any liable carrier/logistic service provider.
We work on a “No Cure No Pay” basis. If we succeed to recover (part of) the damage our fee will be calculated according the Lloyd’s Agency Scale of Fees for Recovery(latest version), which can be made available upon request.
The chance for a good recovery result depends on 1) Cause of the loss 2) Liability exonerating circumstances 3) Liability limiting and/or liability excluding conditions.
